However, the consumer protection watchdog in India has issued a stern warning to these coaching institutes, urging them to refrain from employing misleading and deceptive advertising tactics that prey on the hopes and anxieties of students. This proactive stance aims to ensure transparency and protect vulnerable consumers from unfair trade practices in the booming coaching industry.

One of the most common tactics employed by coaching centers is the prominent display of “toppers” in their advertisements. Often, these ads feature students with impressive ranks, creating the illusion that the institute is a consistent producer of top national performers. However, the reality can be far from this portrayal.

The Central Consumer Protection Authority (CCPA) has specifically cautioned against the deliberate concealment of crucial information, such as whether the featured students were indeed national-level rank holders or simply top performers within the institute itself. Such misrepresentation can significantly mislead prospective students, particularly those in their formative years, into believing that a particular coaching center guarantees top ranks.

Another area of concern for the consumer watchdog is the prevalent practice of advertising inflated and often unsubstantiated success ratios. Coaching centers frequently use bold statements like “Highest success ratio year after year” or claim a specific percentage of their students crack the IIT-JEE.

These claims are often presented without any supporting data, comparative analysis, or third-party verification, leading consumers to believe in unrealistic probabilities of success. The CCPA has emphasized that such unqualified statements violate consumer rights by creating a false sense of assurance and influencing students’ decisions based on misleading information.

The consumer protection authority is stressing the importance of transparency in all advertisements by coaching centers. This includes the clear and conspicuous disclosure of key details such as the student’s name, rank secured, the specific course they enrolled in, and whether it was a paid course.

Furthermore, any disclaimers or important information must be displayed prominently and in the same font size as the claims being made, ensuring that consumers are not misled by fine print or hidden conditions. This emphasis on full disclosure aims to empower students and parents to make informed decisions based on accurate and complete information.

The warning extends beyond just misleading claims about results. The consumer watchdog is also cracking down on other unfair trade practices prevalent in the coaching sector. These include promises of guaranteed placement or selection, assurances of specific ranks, violation of consumer rights related to promised services not being provided, unreasonable cancellation policies with non-refund of fees, and overall deficiency in service. The CCPA has made it clear that such practices are in direct violation of the Consumer Protection Act, 2019, and the recently issued Guidelines for the Prevention of Misleading Advertisements in the Coaching Sector, 2024.

This warning is not an isolated incident. Over the past few years, the CCPA has been actively addressing the issue of misleading advertisements and unfair trade practices by coaching centers. They have issued numerous notices to various institutes and imposed significant penalties on those found to be in violation of consumer protection laws. This demonstrates a clear commitment by the authorities to safeguard the interests of students and maintain ethical standards within the coaching industry.

As the IIT-JEE results approach, the advisory from the consumer protection watchdog serves as a timely reminder for both coaching centers and aspiring students. While coaching can play a supportive role in exam preparation, it is crucial for institutes to market their services ethically and transparently.
