Government to Regulate E-Sports, Prohibit Online Money Gaming 

The Ministry of Electronics and Information Technology (MeitY) is set to introduce a new comprehensive policy aimed at overhauling the online gaming landscape in India. In a significant move, the government plans to officially regulate and promote E-Sports and social games while simultaneously imposing a nationwide prohibition on online money gaming. This decision comes amid a long-standing debate over the distinction between games of skill and chance, and the financial risks associated with real-money gaming.

The new policy, a senior government official revealed, will legally separate the entire online gaming ecosystem into two distinct categories. The first category, which includes E-Sports and social games, will be given a formal regulatory framework. This is aimed at nurturing India’s burgeoning E-Sports talent and providing a legal and safe environment for social gaming platforms that do not involve financial betting. The government’s goal is to position India as a global hub for E-Sports, leveraging its vast youth population and growing digital infrastructure.

In a landmark shift, the second category online money gaming will be completely prohibited. This includes platforms where players wager real money on games of skill. The government’s justification for this drastic step is to protect consumers, particularly the youth, from the financial harm and addiction risks associated with such platforms. This decision effectively ends the long-held legal distinction between games of skill and chance, at least in the context of money gaming. The government official stated, “We will not distinguish between games of skill and chance for money gaming. Both will be prohibited.”

The new regulations are expected to bring all forms of online gaming under the purview of a single, central regulatory body. This is a departure from the current, fragmented system where different states have their own laws, leading to a complex and often contradictory legal environment. The new policy is designed to provide clarity and stability for the industry while prioritizing consumer protection and responsible gaming practices.
