Delhi High Court’s Landmark Decision: Peter England Recognized as Well-Known Trademark

In a significant legal development, the Delhi High Court has officially declared “Peter England,” a prominent menswear brand, as a well-known trademark under Section 2(1)(zg) of the Trade Marks Act, 1999. This recognition not only underscores the brand’s extensive market presence but also provides it with enhanced legal protection against unauthorized use.

The case originated from a trademark infringement lawsuit filed by Aditya Birla Fashion and Retail Limited, the proprietor of the Peter England brand, against Friends Inc. and other defendants. The defendants were accused of unlawfully using the “Peter England” mark on their signboards and invoices. In July 2024, the Court granted interim relief to Aditya Birla, restraining the defendants from using the mark. Subsequently, the defendants confirmed that they had ceased using the infringing materials.

Justice Mini Pushkarna, presiding over the case, noted that “Peter England” has become a distinctive mark, recognized by consumers nationwide. The brand boasts a strong presence with approximately 380 outlets across more than 180 cities. The Court highlighted the brand’s significant sales turnover, which was approximately ₹1,289 crores for the year 2023-2024, and its substantial investment in advertising, amounting to around ₹31 crores in the same period.

The Court also acknowledged the brand’s association with public figures, noting endorsements by celebrities such as actor Ayushmann Khurrana and members of the Chennai Super Kings cricket team. These endorsements have further solidified the brand’s image and recognition among the public.

By declaring “Peter England” as a well-known trademark, the Court has affirmed that the brand has acquired “secondary significance,” meaning that consumers and the trade industry associate the trademark exclusively with Aditya Birla Fashion and Retail. This status provides the brand with enhanced protection against unauthorized use and potential infringements, ensuring that its distinct identity is preserved in the marketplace.
